Welcome to JobNet ("App"), a comprehensive job listings and job search platform provided by JobNet ("we," "us," or "our"). By accessing, downloading, or using our App, you ("user," "you," or "your") agree to comply with and be legally bound by these Terms of Service ("Terms"). These Terms govern your use of JobNet, including all features, services, and content available through the platform. If you do not agree with any part of these Terms, we kindly ask that you refrain from using our App. Your continued use of JobNet constitutes your acceptance of these Terms and any updates we may make over time. JobNet provides a robust platform designed to connect job seekers and employers seamlessly. Specifically, the App offers the following features:
- For Job Seekers: The ability to browse, search, and apply for job listings posted by employers, as well as tools to create personalized profiles, upload resumes, save favorite job postings, and opt-in to receive tailored job alerts via email or in-app notifications.
- For Employers: A streamlined interface to post detailed job openings, manage applications, review candidate profiles, and communicate with potential hires directly through the platform.
- General Features: All users can manage their accounts, update personal or professional information, and engage with JobNet’ tools to enhance their job search or hiring experience.
We strive to make JobNet a user-friendly, efficient, and reliable resource, but we reserve the right to modify or discontinue any feature at our discretion to improve the platform or adapt to changing needs.
3. User Accounts
To fully utilize JobNet, you’ll need to create an account. Here’s what that entails:
- Age Requirement: You must be at least 18 years old to register and maintain an account with JobNet. This ensures all users are legally eligible to enter into this agreement.
- Account Security: You are solely responsible for keeping your login credentials (e.g., username and password) confidential and secure. Any activity under your account is your responsibility, so please notify us immediately at JobNet.reply@gmail.com if you suspect unauthorized use.
- Accurate Information: When setting up your account, you agree to provide truthful, current, and complete information, such as your name, email, and (if applicable) professional details. Misrepresenting yourself could lead to account suspension.
- Account Management: We reserve the right to suspend or terminate your account if we detect any violation of these Terms, such as fraudulent activity, abusive behavior, or posting prohibited content. You’ll be notified if such action is taken, where feasible.
4. Job Listings and Content
JobNet serves as a marketplace for job-related content, with the following guidelines:
- Employer Responsibility: Employers posting job listings are fully accountable for ensuring their postings are accurate, lawful, and compliant with all applicable regulations. JobNet does not verify or assume liability for the truthfulness or legitimacy of these listings.
- No Endorsement: We do not endorse, sponsor, or guarantee the quality, availability, or validity of any job listings or user-generated content (e.g., profiles, resumes, or reviews). You use this content at your own risk.
- Content Standards: You agree not to upload or share anything illegal, offensive, discriminatory, defamatory, or that infringes on intellectual property, privacy, or other rights. Examples include hate speech, spam, or misleading job offers.
- Content Removal: We may, at our sole discretion, remove any content that violates these Terms or harms the JobNet community, without prior notice.
- Legal Compliance: Employers must adhere to all relevant local, state, and federal labor laws, including wage requirements, anti-discrimination statutes, and workplace safety regulations, when posting jobs or hiring through JobNet.
5. User Conduct
To keep JobNet a safe and productive space, you agree not to:
- Use the App for any illegal or unauthorized activities, such as scams, phishing, or distributing malware.
- Impersonate any individual, organization, or employer, or falsely claim affiliation with JobNet or another entity.
- Disrupt the App’s functionality, such as by overloading servers, launching denial-of-service attacks, or tampering with its code.
- Collect, harvest, or misuse other users’ personal data (e.g., emails or profiles) without their explicit consent.
- Introduce viruses, worms, trojans, or any harmful code that could compromise the App or its users.
- Attempt to hack, reverse-engineer, or gain unauthorized access to JobNet’ systems, databases, or other users’ accounts.
- Deploy bots, spiders, or other automated tools to scrape data or interact with the App, unless you have our express written permission.
Violation of these rules may result in immediate account suspension and potential legal action, depending on the severity.
6. Intellectual Property
JobNet’ intellectual property is protected, and we respect yours too:
- Our Rights: The App, including its design, text, logos, graphics, software, and underlying code, is owned by JobNet and safeguarded by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without our explicit written consent.
- Your Content: Any content you submit (e.g., job listings, profiles, or resumes) remains your property. However, by uploading it, you grant JobNet a non-exclusive, royalty-free, worldwide license to display, store, and use that content as needed to operate the App—such as showing your job listing to job seekers or featuring your profile in search results.
- Respecting Others: You must not post content that infringes on third-party rights, like using someone else’s trademarked logo or copyrighted text without permission.
7. Disclaimer of Warranties
We aim to make JobNet reliable, but there are limits to what we can promise:
- As-Is Basis: JobNet is provided "as is" and "as available," meaning we don’t guarantee it’ll always work perfectly. Technical issues, downtime, or errors may occur, and we’re not liable for them.
- No Warranties: We disclaim all warranties, whether express, implied, or statutory—including warranties of merchantability, fitness for a particular purpose, or non-infringement. For example, we can’t promise a job listing will lead to employment or that the App will meet all your expectations.
- Use at Your Risk: You assume the risk of using JobNet, including any reliance on its content or interactions with other users.
8. Limitation of Liability
Our liability is capped to protect JobNet and you:
- No Damages: We won’t be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App—whether it’s lost profits from a missed job opportunity, data loss, or emotional distress.
- Legal Limits: If liability does apply, it’s limited to the maximum extent allowed by law. This means our responsibility, if any, won’t exceed what’s reasonable under applicable regulations or circumstances.
- External Factors: We’re not responsible for issues beyond our control, like internet outages, third-party actions (e.g., an employer’s conduct), or device malfunctions.
9. Indemnification
You agree to protect JobNet from harm caused by your actions:
- Your Responsibility: You’ll indemnify, defend, and hold JobNet, its affiliates, employees, and partners harmless from any claims, losses, damages, or expenses (including legal fees) arising from your use of the App or breach of these Terms.
- Examples: This applies if someone sues us because you posted a fraudulent job listing, misused another user’s data, or violated intellectual property rights through JobNet.
- Cooperation: If we face a claim, we may ask for your assistance in defending it, and you agree to cooperate reasonably.
10. Changes to Terms
These Terms aren’t set in stone—we may update them as JobNet evolves:
- Updates: We can revise these Terms at any time to reflect new features, legal requirements, or operational changes. We’ll notify you by posting the updated Terms on the App, sending an email to JobNet.reply@gmail.com subscribers, or using in-app alerts.
- Acceptance: Your continued use of JobNet after these changes means you accept the new Terms. If you disagree with an update, you can stop using the App and contact us to close your account.
- Review: We encourage you to check this page periodically to stay informed about your obligations.
11. Termination
Your access to JobNet isn’t guaranteed forever:
- Our Right: We can suspend or terminate your account or access to the App at our discretion, with or without notice, for reasons like violating these Terms, suspected fraud, or operational needs (e.g., shutting down a feature).
- Your Right: You can also terminate your account by deleting it through the App’s settings or contacting us at JobNet.reply@gmail.com.
- Aftermath: Upon termination, your right to use JobNet ends, but these Terms’ provisions (like indemnification and liability limits) that logically survive will remain in effect.
12. Governing Law
These Terms are governed by a specific legal framework:
- Jurisdiction: They’ll be interpreted and enforced under the laws of the State of California, USA, without regard to its conflict-of-law principles. This applies unless local laws in your region override it for consumer protection reasons.
- Disputes: Any legal disputes arising from these Terms or your use of JobNet will be resolved in the state or federal courts of California, and you consent to their jurisdiction.
